Its not our policy, its the law. If you say that its a gift, than its a gift and there is no sales tax collected.

I was surprised to learn when picking up a transfer this week that this is no longer practiced at NFA and sales tax was collected on behalf of the State of Nevada. Guido, would you mind shedding some light on this, please?

Was it a gift? Did you say it was a gift? Was there an invoice stating how much you paid?

Yes, "GIFT" was shouted from the rooftop (that's an exaggeration) and the vendor was instructed to not send an invoice. I even referenced Guido's post dated 9/9/15. I was told that that the following is their new policy:

"Even if no invoice is included, a statement from the seller will be needed stating that there were no funds exchanged or the appropriate tax was paid in the state in which the item was purchased. Without proof of an item being a gift, we are being instructed to not transfer the item until sufficient proof is provided."

I don't fault NFA as they are just protecting themselves, however it would have been nice to have not been blind-sided.

Can't say that I'm surprised. Guido runs a above-board shop and I knew the "wink-wink" policy couldn't last long. The state is committed to its pound of flesh and I'll bet they are threatening the gun shops with audits.

Shouldn't be for a private sale. Doesn't a business need a tax ID number in order to charge tax in the first place?

They will collect tax, even on a private sale unless it's a gift. Even so, a letter from the sending party stating that it's a gift will be necessary.

I read a letter posted at another shop that says private sales aren't taxed, but they want to see paperwork (bill of sale) from a private seller. It didn't have to be a "gift" but couldn't come from someone with an FFL basically.

Very interested in NFA's opinion on this, as I know they are very pro-freedom, so I expect they do whatever they can for us.

Unfortunately it's not really our opinion, the guidance is pretty clear now from department of taxation. We continue to fight this reg, but no luck yet.


If it's a private sale between 2 NV residents done in our store for the sole purpose of the background check it is NOT subject to sales tax.

If it's a used gun bought from out of state it IS subject to sales tax unless it's a gift. Same as if you buy a used car out of state or we sell a used gun to you from our inventory.

Speaking of transfer fees -- if two NFA items come in at the same time are both subject to the $50 transfer for a total of $100, or are they combined like a regular firearm transfer?

With class 3 items (unless they are multiples of the same make/model that we can put on the same forms) it's a per item charge because of the additional time and paperwork that's involved in the process.

Sorry for the silly question but Ive never ordered online to an FFL.

Does the $25 transfer fee cover up to 3 transfers on a single order?

Or would it be $75 for 3 transfers on the same order, and $5 per item after?
