Since it has a brace the tax stamp is free so long as you submit your Form 1 before the 120 day grace period expires (which hasn't started yet).

I thought the pistol had to be owned by the submitter by 1/31/2023 to be eligible?

That post was made before the publication date of the final rule but now you are right, the free stamp would not apply if the gun wasn't in the buyer's possession as of 1/31.

Also, to keep things legal I will remove the brace from the gun to do the transfer and offer it as a free add-on if the buyer chooses to SBR using the brace later on.
